  • Provide an independent, impartial and objective source of information for individuals seeking internship and graduate positions at leading institutions in Australia
  • Provide a forum for communication between job seekers and recent graduates
  • Provide a forum for users to access and contribute opinions through the review functionality

Gradvantage is developed, created and managed by Australian Business Number 76 560 823 079; referred to in the Terms and Conditions using pronouns including but not limited to, “we” “us” and “our”. The following terms and conditions (“Terms and Conditions”) govern the use and access to the website found at URL address http://www.gradvantage.com.au, hereafter known as Gradvantage (“Gradvantage”) or website (“website”). The user (“user”) refers to any individual or entity that accesses, visits or uses the website or any of the services, features or functionality available on the website.
The applicable law governing these Terms and Conditions is the law of New South Wales, Australia. The user agrees to the exclusive jurisdiction of the courts of New South Wales to determine any dispute or matter that arises in connection to these Terms and Conditions.
By using Gradvantage, you accept and agree to these terms and conditions. Please stop visiting Gradvantage or using the sites features and functionality if you do not agree to the terms and conditions.

In these Terms and Conditions:

User Submissions
We do not necessarily support, endorse, sanction, encourage or agree with any submitted material or any recommendation, advice or opinion contained within submitted material.
Any and all information, comments, reviews, ideas, suggestions, concepts, communications, creative works, academic works, demos, photographs, drawings, depictions, methods, systems, designs, plans, techniques or other materials submitted or sent to us (“Submitted Materials”) will be deemed to not be confidential or secret, and may be used by us in any manner consistent with Gradvantage’s Terms & Conditions and Privacy Policy. Materials may be submitted the following ways:

  • Posts to the website and/ or message boards
  • Reviews and comments
  • Forums, chat rooms, blogs and or online communities made available by Gradvantage
  • Communication with us directly
  • All users must act in good faith when participating on Gradvantage. This includes but is not limited to submissions, comments or reviews.

 

  • Users must not submit any intellectual property that is owned by other individuals/ third parties. Users must only contribute their own work, which must be accurate

 

  • All contributions are the views and opinions of individual users and are not the views or opinions held by Gradvantage Pty Ltd (Australian Company Number 153 324 460), unless stated otherwise

 

  • Any user behavior or action that defames, harasses, misleads, or offends other parties is strictly prohibited.

 

  • We reserve the right to modify or remove any contributions to the website, especially if deemed inappropriate, offensive, misleading, irrelevant or not in good faith. We may edit, not post or remove any content or material that breaches these Terms and Conditions, or is in any way objectionable, or violates any Australian or international law at are absolute discretion. We are at no time responsible for any of the content or material that is posted on the website.

 

  • All user contributions (including but not limited to comments, reviews and discussions) become our property once submitted, who will thereby have exclusive, fully tranferable, assignable and sublicensable, irrevocable, worldwide, royalty-free, and unrestricted rights. Prohibited User Conduct

  • Every user agrees that while using or viewing Gradvantage, the user will not:
    • Use Gradvantage or its services in violation of our legal and/ or proprietary rights
    • Modify, change, alter, translate, sublicense, sell, reverse engineer, decompile or otherwise disassemble any portion of Gradvantage or cause any other individual, entity, institution or organization to do so (except to the extent that such actions are permitted by applicable law)
    • Use Gradvantage, its features, functionality and/or services in violation or circumvention of any applicable law or regulation in any jurisdiction
    • Use code or any other device on Gradvantage to direct users to any other website or webpage
    • Interfere with any other party's use and enjoyment of the Site. This includes, but is not limited Harming, intimidating, harassing, stalking, abusing, threatening or otherwise offending members. This also includes the sending of mass unsolicited messages and attempting to overwhelm the server with requests
    • Delete legal/ proprietary notices or attributions on Gradvantage
    • Transmit or authorise the transmission of unsolicited emails, instant messages, "junk mail," "chain letters" or “spam”
    • Use Gradvantage, its features, functionality and/or services in a manner that could damage, interrupt, disable, overburden or impair the website
    • Attempt to reverse engineer, decrypt, or otherwise alter or interfere with the Gradvantage or its features, functionality and/or services

This includes but is not limited to “screen scraping,” “database scraping” and/or harvesting e-mail addresses and/or other information from any server or database connected with the website
    • Use Gradvantage with automated scripting software or tools
    • Replicate, copy, mirror or frame any part of Gradvantage without having sought and received prior written authorization
    • The user is solely and wholly responsible for the content and consequences of any activities engaged in while using or visiting Gradvantage
  •  In any and all chat/ messaging services, reviews, bulletin/ message boards, blogs and other similar forums, online communities and services that Gradvantage may provide, the user agrees not to use Gradvantage to post, upload, transmit, distribute or otherwise distribute:
    • Any material that the user suspects or knows (or should have reasonable suspected or known) to be false, fraudulent, misleading and/ or deceptive
    • Any material or content that encourages any conduct that would give rise (or is itself subject) to civil liability, constitute a criminal offense, or otherwise violate any local, state, national or international laws
    • Any material or content that is unlawful, threatening, abusive, harassing, hateful, objectionable (racially, ethnically, religiously or otherwise), defamatory, obscene, vulgar, offensive, libelous, pornographic, profane, sexually explicit/ indecent or connotative
    • Any material or content is likely to offend, insult or humiliate other users or the public on the basis of, ethnicity, race, religion, gender, age, sexual orientation or disability (whether physical or mental)
    • Any material or content that religiously or racially vilifies other users or incites religious or racial hatred or violence
    • Any material, content or work that is not the user’s own original work or infringes intellectual property rights of any other third party (whether an individual, corporation, organisation or entity). This includes but is not limited to contractual rights, copyright rights, trademarks, confidentiality, patents, privacy or other right
    • Any confidential, sensitive or proprietary information
    • Any material or content that exploits any other user, individual, corporation, entity or government in any way
    • Any sexual explicit material or content including but not limited to sexual acts/ references, nudity and anything pornographic
    • Any material or content that may or does violate the privacy of any individual by providing personal information without due and proper consent
    • Any material or content that could reasonably pose a privacy or security threat/ risk to any individual
    • Any material or content that is irrelevant, repetitive, unwanted or untargeted
    • Any material or content that is hidden, password restricted or requires some other mechanism to access
    • Any material or content that contains or is itself spyware, a virus or anything that is harmful or malicious
    • Any material containing unauthorized advertising, pyramid schemes or chain letter/ electronic communication. This includes but is not limited to any material that promotes any good, service or commercial enterprise
    • Any material containing financial, legal, medical or any form of professional advice

User Accounts, Registration and Passwords
Registration on Gradvantage is free. Users will be asked to create a username and password when creating an account. Users will be required to register and obtain membership to access certain website features and use Gradvantage features and functions. Membership will be required for:

  • Joining the online community or participating in forums
  • Writing reviews
  • Using “Vantage Point”
  • Customising news feeds
  • We reserve the right to deactivate, suspend, delete or alter Gradvantage accounts or usernames at our absolute discretion.
  • We have absolute discretion to cancel any account if we suspect that it is being used by an unauthorized individual/ user
  • We reserve the right to prohibit or ban users from registering or activating an account at our absolute discretion.

  • Users agree:
    • Not to disclose or divulge the user’s password to any other person, website or entity
    • To take responsibility for maintaining password confidentiality
    • To take full responsibility for all liability penalty arising from misusage of the user’s account (based on password based access) whether or not the user had prior knowledge of a password being compromised
    • To notify us immediately (either through email or alternatively via the “Contact Us” page on the Gradvantage homepage) if the user suspects that their account has been compromised. We have the ability to reset your password in such circumstances

Security

  •  While we try to keep Gradvantage as safe as possible, it is the user’s responsibility to ensure they have adequate virus and firewall protection in the event that Gradvantage is compromised.
  • We are not responsible and take no liability for any damage to any user’s personal computer (or internet compatible device) or viruses affecting any user’s property on the basis of downloading, accessing, using or browsing any videos, images, data, material, information, content, features or functions made available through Gradvantage.



External and Third Party Links

  • Gradvantage may link to an external third party website and an external third party website may link to Gradvantage. The user acknowledges and agrees that we have absolutely no responsibility for the material, content information, products, services, advertising, code or any other material provided on external third party websites. Links to external third party websites do not constitute our endorsement or sponsorship of such external third party websites or the material, content information, products, services, advertising, code or any other material on such websites.
  • The user assumes all risk and responsibility for reliance on any external third party websites, whether or not linked to Gradvantage. We do not accept any responsibility whatsoever for any transactions, communications or happenings between the user and the third party, even if the user contacts the third party using Gradvantage.
  • We do not take any responsibility and accept no liability for any loss, damage, issues or problems that may arise from the use of external website.
  • Gradvantage is not responsible for the content on third party website. We do not guarantee the accuracy or reliability of any material appearing on such sites.
  • Any views or opinions expressed on external or third party website does not necessarily reflect our views and as such, we do not automatically condone any views or opinions expressed on third party website.
  • Occasionally, we may advertise, promote or sponsor offers, competitions, functions, events or other activities that are physically conducted (conducted offline) by third parties. These activities may be subject to different Terms and Conditions. The user agrees to participate in such offers, competitions, functions, events or other activities at their own risk. We do not accept any responsibility whatsoever in connection with the user’s participation in offers, competitions, functions, events or other activities conducted by third parties.
  • Without express written permission, users are not permitted to link directly to any image hosted on Gradvantage for any purpose. The user agrees not to:
    • Use, upload or post images on Gradvantage on any external side for any purpose
    • The use of an “in-line” linking method that causes host images to be displayed on external websites
    • Link from any external website to Gradvantage in such a manner that the external website is obfuscated or surrounded by third party material, advertising, branding or content.
  • We have absolute discretion to revoke the user’s ability to link to Gradvantage from any external website



Indemnification
The User agrees to defend, indemnify and hold us, our affiliates, officers, employees and agents harmless from any and all costs, expenses (including legal expenses and solicitor fees), liabilities and claims arising from the user’s:

  • Use or Gradvantage or any features/ functions
  • Access to Gradvantage
  • Posting, placement, transmission or submission of any material, content, message, software related to Gradvantage
  • Breach or violation of the Australian or international law
  • Breach or violation of these terms and conditions

Disclaimer of All Warranties
